Welcome to The Pray App. By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By downloading, installing, accessing, or using The Pray App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the app on your personal device for personal, non-commercial purposes only. You may not:

• Copy, modify, or create derivative works of the app
• Reverse engineer, decompile, or disassemble the app
• Remove or alter any proprietary notices or labels
• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks

3. User Accounts and Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that all information you provide is accurate and current
• Notifying us immediately of any unauthorized use of your account

This app is rated 4+ and suitable for all ages. If you are a minor, we recommend using the app with parental awareness.

4. User-Generated Content

You retain ownership of any content you create in the app, including prayer cards, journal entries, categories, and answered prayer records. By using the Service, you grant us a limited license to store, process, and sync your content solely for the purpose of providing the Service to you. Your prayers remain private and are not shared with third parties except as described in our Privacy Policy.

AI features: Two optional features, organizing a pasted prayer list into prayer cards and daily Bible commentary, send the text you give them to an AI provider. This happens only when you use them. See our Privacy Policy for details.

5. Pricing and Supporter Subscription

Free Access: The Pray App is fundamentally free. The free tier is designed to serve the vast majority of users indefinitely without any payment. Nobody is required to pay. Free users can create up to 500 active prayer cards and 10 categories, along with full access to the core prayer experience including prayer sessions, journaling, timeline, and statistics.

Why Limits Exist: We want to keep The Pray App free for as many people as possible. However, servers, development, and infrastructure have real costs. To manage these costs and ensure we can continue improving the app, we've implemented generous limits on the free tier. These limits may be adjusted over time to balance accessibility with sustainability.

Supporter Subscription: The Supporter subscription is entirely optional. You may choose to become a Supporter for one of two reasons:

• You've reached the free tier limits and need unlimited prayer cards and categories
• You want to support the mission of keeping The Pray App free and accessible for others who cannot afford to pay

Supporters receive these benefits:

• Unlimited prayer cards and categories
• Bulk prayer creation from text
• Full answered prayer timeline
• In-session editing and archiving
• The satisfaction of helping keep the app free for others

Billing: The Supporter subscription is billed annually at the price displayed at the time of purchase (currently $9.99/year in the United States, with prices varying by region). Payment is charged to your Apple ID account at confirmation of purchase. Your subscription helps cover server costs, development, and enables us to continue offering a generous free tier to those who need it.

Auto-Renewal: Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Managing Your Subscription: You can manage or cancel your subscription at any time through your Apple ID account settings or the Settings screen in the app. Cancellation takes effect at the end of the current billing period.

Refunds: All subscription purchases are processed by Apple. Refund requests must be submitted to Apple through their standard refund process. We do not process refunds directly.

Feature Access: If your subscription expires or is cancelled, you will retain access to your data but will lose access to Supporter features. Your existing prayer cards and content are never deleted due to subscription status changes. You will continue to have access to the generous free tier.

6. Intellectual Property Rights

The Service, including all content, features, functionality, software, designs, text, graphics, logos, icons, images, and the selection and arrangement thereof, is owned by WHHY LLC, its licensors, or other providers of such material and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Our trademarks, service marks, and logos may not be used without our prior written consent. All other trademarks not owned by us that appear in the Service are the property of their respective owners.

7. Prohibited Conduct

You agree not to:

• Use the Service in any way that violates any applicable laws or regulations
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Introduce viruses, malware, or other malicious code
• Attempt to bypass any security features or access restrictions
• Use automated systems (bots, scrapers, etc.) to access the app or its servers and APIs. This doesn't apply to this website. Bots, search engines and AI agents are welcome to read and cite its pages.
• Harass, abuse, or harm other users

8. Service Availability and Modifications

We strive to provide a reliable Service, but we do not guarantee that the Service will be available at all times or free from errors, bugs, or interruptions. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Impose limits on certain features or restrict access to parts of the Service
• Update or change the Service without prior notice

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, secure, or error-free
• Any data or content will be accurate, reliable, or complete
• Defects will be corrected

IN NO EVENT SHALL WHHY LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless WHHY LLC, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You must delete the app from all your devices
• We may delete your account and content, though we may retain certain data as required by law

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. The arbitration shall take place in the United States.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms with a new effective date
• Sending you a notification through the app or email

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WHHY LLC regarding the Service and supersede all prior agreements and understandings.
